Conveyancing is the legal process of transferring the legal title of Real Estate (Property) from one person to another. In a general conveyance, there will be two major phases being Exchange and Settlement.

What is Exchange? Exchange occurs where each party being the Seller, and the Buyer sign a Contract to sell and purchase the Property. In usual circumstances the Exchange will occur subject to a cooling off period which is for the benefit of the Purchaser, to allow for necessary due diligence to be undertaken on the Property and finalise any loan that may be required to fund the purchase the Property. Should all be satisfactory to the Purchaser, Contracts will become unconditional and binding upon both parties.

What is Settlement? Settlement is the final stage in a conveyance where the monies due for the Property are paid to the Seller and the legal title to the Property is transferred to the Buyer. The local authorities such as Council and Water will be notified that the Property has been sold and will forward any relevant notices to the new owner. If there is a Mortgagee, the Mortgage will also be registered on the title of the Property securing their rights as the Mortgagee on Title.
